1. About these terms
These Terms of Service govern your use of labels43.com and the Labels43 hosted software, APIs, documentation, and related services provided by Perseuss LLC, 33 Ashland Avenue, West Orange, NJ 07052, United States. By using the services, you agree to these terms. If you act for a business, you confirm that you are authorized to bind that business.
A signed agreement or order form may set additional terms for your deployment. If it conflicts with these terms, that agreement controls for the services it covers.
2. Accounts and connected systems
You are responsible for your users, API keys, database credentials, and access to connected stores, carriers, warehouse systems, and communications tools. Connect only accounts and data you are authorized to use. Tell us promptly if you suspect unauthorized access.
You are responsible for the accuracy of information you provide, including inventory, addresses, package details, customs information, shipping rules, and carrier account settings.
3. Hosted deployments and source code
Your deployment may include source access, a hosted fork, and database access as described in your agreement. Rights to use, modify, and distribute source code are governed by the license included with that code. Source access does not transfer ownership of our trademarks or third party software.
You may build tools, add fields, write migrations, create indices, and submit changes within the access granted to your deployment. You are responsible for reviewing and testing changes made by your team or AI agents, including their effect on data, performance, security, and connected systems. Hosting, support, and deployment arrangements remain subject to your agreement.
4. Your data
You retain ownership of your business data. You authorize us and our service providers to host, process, transmit, and maintain it as needed to provide the services, support your deployment, secure the services, and comply with law. Source code access does not make your business data public.
You are responsible for obtaining any permissions needed to process customer, employee, or other personal information through the services. Our Privacy Policy explains our handling of personal information. Any applicable data processing agreement also governs our processing on your behalf.
5. Shipping and third party services
Rates, delivery dates, carrier availability, and shipping decisions depend on your configuration and information from connected providers. Unless expressly agreed in writing, dates and rates are estimates, not guarantees. Carrier terms, surcharges, restrictions, adjustments, and delivery conditions apply.
Third party services have their own terms. We do not control their availability, pricing, or performance. You remain responsible for selecting lawful shipping services and providing accurate shipment and customs information.
6. Fees
Hosting, usage, shipping, and other fees are specified in your order form, service agreement, or the pricing accepted for your account. Open source licensing and paid hosting are separate arrangements. Access to source code does not by itself waive agreed fees. Changes to pricing will be communicated as required by your agreement and applicable law.
7. Acceptable use
Do not use the services unlawfully, access another customer’s data, interfere with service availability, bypass access controls, distribute malicious software, or expose credentials. You are responsible for activity by users and agents you authorize.
8. Service changes and access
We may update the services and documentation. Availability, maintenance, support, and any service commitments are governed by your agreement. We may restrict access where reasonably necessary to address security threats, unlawful use, or a material breach of these terms, subject to applicable law and contractual obligations.
9. Warranties and liability
Except as expressly stated in a signed agreement, and to the extent permitted by law, the services are provided as is and as available without warranties of merchantability, fitness for a particular purpose, or noninfringement. No service can guarantee uninterrupted availability or error free operation.
To the extent permitted by law, Perseuss LLC is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost sales, or business interruption arising from the services. Nothing in these terms excludes liability or rights that cannot lawfully be excluded.
10. Governing law and updates
These terms are governed by New Jersey law, excluding its conflict of laws rules, subject to mandatory applicable law. We may update these terms by posting a revised version and effective date. We will provide additional notice where required by law or your agreement. Continued use after the effective date is subject to the updated terms.
